Monty's Macros Terms of Service

1. Acceptance of Terms

By accessing or using the websites (e.g., montysmacros.com), applications, or software provided by Monty’s Macros (“we,” “us,” or “our”), you (“user,” “you,” or “your”) agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use our websites, applications, or software.

2. Description of Services

Monty’s Macros provides software, AppleScripts, and macros to assist with workflow automation in areas such as productivity, photography, videography, and audio/video editing. Our "Master App" serves as a distribution and installation platform for software licenses previously purchased via our WooCommerce store. We do not provide any creative, professional, or consulting services. Users are solely responsible for the results of any tasks performed using our software.

3. User Responsibilities & Risk

You agree to:

• Use our software and websites in compliance with all applicable laws.
• Maintain the confidentiality of your account credentials used to access the Master App.
• Not reverse-engineer, decompile, or redistribute the source code of any AppleScripts provided.
• Ensure that any third-party software or plugins required by our macros are properly licensed and compatible.

Risk Disclaimer: You acknowledge that automation scripts and macros may modify files or system settings. You agree to maintain current backups of all data and projects. You use the software at your own risk; Monty's Macros is not responsible for data loss, accidental file modification, or other outcomes of software use.

4. Intellectual Property & Licensing

• Ownership: All content, code, and macros are the property of Monty’s Macros.
• License: Upon purchase, you are granted a limited, non-exclusive, non-transferable license for personal or internal business use.
• Revocation: Monty’s Macros reserves the right to revoke a license or access to the Master App if these Terms are violated or if unauthorized distribution occurs.
• Custom Work: Ownership of custom software will be transferred to the client only upon receipt of full and final payment.
• Restrictions: You may not reproduce, redistribute, or create derivative works of our software without express written permission.

5. Payment & Refund Policy

• Pre-built Software: Payment is due at checkout. All sales are final once the software has been accessed or downloaded.
• Custom Development: Payment is due NET 15 days from the invoice date. No refunds are provided once work has commenced.
• Late Payments: Overdue balances may incur a 2% monthly late fee. Accounts exceeding 30 days past due may have software access suspended until the balance is cleared.

6. Limitation of Liability & "As-Is" Warranty

Monty’s Macros provides software “as-is” with no warranties regarding functionality, compatibility with future macOS updates, or third-party applications (e.g., Adobe Creative Cloud). To the fullest extent permitted by law, Monty’s Macros shall not be liable for any damages, including but not limited to loss of data, loss of profits, or business interruption, arising from the use, inability to use, or results of the software.

7. Termination

We may terminate or suspend access to our software at any time, with or without cause, by providing notice via email. You may terminate your account via written notice; however, outstanding payment obligations remain in effect.

8. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law provisions.

9. Dispute Resolution

Disputes will first be attempted to be resolved through direct negotiation. Any unresolved disputes may be submitted to binding arbitration in the County of Los Angeles, California, under the rules of the American Arbitration Association, or another method jointly agreed upon in good faith.

10. Changes to Terms

We may modify these Terms at any time. Material changes will be posted on our website. Continued use of the Master App or software after changes are posted constitutes your acceptance of the revised Terms.
